Individuals who enter Canada to conduct after-sales/lease services are a typical sub-category of the business visitor work permit exemption.

Candidates must be seeking entry to repair, service or set-up (which does not include hands-on operations), test or supervise work on equipment, machinery or software manufactured outside of Canada and purchased outside of Canada by a Canadian firm (e.g., a Canadian manufactured product is sold in Canada by a U.S. entity).

As part of the initial contract or an extended sales agreement, lease or rental agreement, warranty, or service contract, after-sales and leasing services must be provided.

An Original Equipment Manufacturer or employee of the OEM, or a third party named in the original of sale agreement for that specific purpose, shall execute the service as required.

As long as it is provided for in the original sales agreement or extended warranty, the foreign national can:

  • Install, configure, and test commercial equipment, machinery, or software, if such activity necessitates proprietary or product-specific knowledge;
  • Canadian personnel will be trained or supervised in the use of commercial equipment, machinery, and software.
  • Installers of commercial equipment, machinery, and software must be supervised.
  • Repair and maintain commercial machinery, equipment, and software;
  • Upgrade the software on your computer.
